Mandatory Reporter Policy (New York State)

 

Effective Date: 01/01/2026

ROC Youth Community Engagement recognizes the legal and ethical responsibility to protect children from abuse, neglect, and exploitation.

This policy outlines expectations related to mandatory reporting requirements under New York State law.

Legal Framework

New York State Social Services Law requires certain professionals to report suspected child abuse or maltreatment when they have reasonable cause to believe that a child has been harmed or is at risk of harm.

These reports must be made to the New York Statewide Central Register of Child Abuse and Maltreatment (SCR).

What Must Be Reported

Staff must report when they have reasonable cause to suspect:

  • physical abuse
     
  • sexual abuse or exploitation
     
  • emotional abuse
     
  • neglect
     
  • abandonment
     
  • situations where a child’s health or welfare may be endangered
     

Reports should be made even if full confirmation is not available. Suspicion based on reasonable observation is sufficient under the law.

Reporting Procedure

If abuse or neglect is suspected, the following steps should be taken immediately:

  1. Ensure the immediate safety of the child if necessary.
     
  2. Notify appropriate organizational leadership or supervisors when possible.
     
  3. Contact the New York State Child Abuse Hotline (SCR) to make a report.

After making a report by phone, mandated reporters may be required to complete the appropriate written reporting form as required by New York State law.

Good Faith Protection

New York State law provides legal protection to individuals who report suspected abuse in good faith.

Individuals making reports in good faith are protected from civil or criminal liability related to the report.

Confidentiality

The identity of individuals making reports is protected under New York law.

Information related to reports must remain confidential and should only be shared with appropriate authorities or supervisory staff when necessary.

Organizational Responsibility

RYCE supports staff in fulfilling their legal responsibilities related to child protection.

The organization encourages staff to prioritize the safety of youth and to report concerns without hesitation.

Failure to report suspected abuse when required by law may carry legal consequences under New York State law.

Training and Awareness

RYCE promotes ongoing staff education regarding:

  • recognizing signs of abuse and neglect
     
  • trauma-informed responses
     
  • mandated reporter responsibilities
     
  • youth protection practices
     

Training helps ensure that staff are prepared to respond appropriately when concerns arise.
